High Court orders closure of all brick kilns

Agartala, July 6, 2019: High Court of Tripura directed all brick kiln’s in the state should be closed immediately   and not  allowed to operate  and carry out any commercial activity, without complying the statutory provisions and more specifically, the environmental clearances. Chief Justice Sanjay Karol and Justice Arindam Lodh passed the order on July 3 (Wednesday).

The High Court passed the order after examining the affidavit filed by Prof B.K. Aggarwal that almost all the brick kilns within the state are running without having obtained or submitted the environmental clearances.

The High Court while hearing a PIL on May 29,2019 for protection and conservation of forest wealth in Tripura.  As part of it the brick kilns running  within the state  causing serious threat to forest wealth.  Chief Justice Sanjay Karol and Justice Arindam Lodh  interacted with Prof BK Agarwala, Chairman of Tripura Pollution  Control Board, Dr. Alind Rastogi, PCCF, Dr. K K Sharma MS,TBB and Sunil Kumar Agarwal   addl. PCCF ( central).

The court directed the Chairman and member secretary of the State Pollution Control Board to personally undertake to carry out physical inspection all the brick kilns unit within the state for ascertained factum of compliance of the statutory laws and regulations. The court directed to submit  an affidavit within two weeks.    

In the affidavit submitted by Pollution Control Board it was mentioned that there are 393 brick kilns in the state. Last year 280 brick kilns was functional, 70 brick kilns last was not functional due to scarcity of coal and 43 brick kilns were found permanently non – functional. It was found almost all brick kilns are running without having obtained or submitted the environmental clearances.
