Justice Akil Kureshi's name recommened as CJ of Tripura high court

Agartala, Sept 21,2019:The Supreme Court Collegium on Friday modified its earlier recommendation to appoint Justice Akil Kureshi as the Chief Justice of Madhya Pradesh High Court. The collegium has now recommended that Justice Kureshi be appointed as the Chief Justice of Tripura High Court.

After sending two recommendations to elevate Gujarat HC Justice Kureshi as Chief Justice of MP High Court, the SC collegium has bowed to the government objections and changed his appointment to Tripura HC Chief.

The collegium's decision comes after the Center once again raised objections to Justice Kureshi's elevation.

A lawyers'association in Gujarat had also filed a PIL in the Supreme Court against the delay in Justice Kureshi's appointment as chief justice.

The Gujarat bar has alleged that Justice Kureshi appointment was being blocked by the Center because he had passed strictures against Amit Shah when he was the state home minister.

The SC had sent his name for MP High Court twice but after the Centre returned the files with objections, the collegium backtracked.

The MP High Court is one of the largest high courts in the country, while Tripura is a small court with much fewer cases to handle.

Gujarat High Court Advocates Association president Yatin Oza had earlier alleged that Justice Kureshi's elevation was being opposed by the government as he had in 2010 passed orders remanding current Union Home Minister Amit Shah to police custody.

The petition filed by the lawyers association had argued that the delay in confirming Justice Kureshi appointment, even though names of other judges had been cleared by the Centre was "against the procedure laid down in the Memorandum of Procedure (MoP) and amounts to a violation of Articles 14 and 217 of the Constitution."
