Panchabati Massacre: High Court uphelds lower court verdict , a jolt for the govt

Agartala, March 17 (TVN):In a major setback for state government, the High Court of Tripura on Wednesday upheld the verdict of Additional Sessions Court, West district relating to Panchabati market massacre.

Chief Justice Deepak Gupta expressed his unhappiness over the role of state government for ‘illegally withdrawing’ the case against six out of seven arrested ATTF extremists during the trial of the case in the year 2005. The High Court  in its order  stated it was unfair on the part of the government  by withdrawing the case against six militants was unfair.

A group of 30 to 35 All Tripura Tiger Force (ATTF) militants had gunned down altogether 18 people including policemen, injured 11 persons and kidnapped 6 persons at Panchabati market on November 14, 1999.After investigating the case vide-  Sidhai  PS 57/2001, the cops had charge-sheeted a total of 10 extremists including two absconders. Altogether 21 witnesses were examined at the court of the then Additional Sessions Judge, West district- Udit Chowdhury. In the year 2005, the state government had filed a petition before the Additional Sessions Court praying for withdrawing the case against six amongst the seven arrested militants.

On the other hand, Dulal Pandey amongst the arrestees was acquitted from the charges on the ground of lack of evidence on November 05, 2005.After that, the state government filed a supplementary charge-sheet along with statements of some new witnesses against ATTF supremo Ranjit Debbarma in connection with the Panchabati market massacre on January 01, this year. In their statements, the witnesses, also the members of ATTF, mentioned that Ranjit in a sitting with them had designed the conspiracy of Panchabati market attack.

However, the Additional Sessions Judge, West district- Udit Chowdhury rejected the supplementary charge-sheet on January 19, this year saying that if Ranjit was guilty in making the conspiracy of Panchabati market then the new witnesses, who gave statements, were equally guilty for the same.

Challenging the trial court’s order, the state government  appealed  the High Court of Tripura and filed a petition. The petition today appeared before the High Court of Tripura.
